Subject: Respect Treaty Rights and Re-engage First Nations on Bill C-37

Dear Minister Gull-Masty,

I am writing to express deep concern regarding the recent introduction of Bill C-37 (the First Nations Clean Water Act). Safe drinking water for First Nations must be an absolute priority, and I am also very troubled by the lack of direct input of First Nations during its drafting.

I want to echo the concerns raised by the Chiefs Steering Committee on Technical Services (CSC) on June 16, 2026, representing Treaty 6, 7, and 8 Nations. Despite your government’s commitment to the Treaty Bilateral Table on Water and Related Infrastructure, this legislation was advanced behind closed doors without early discussion and input from First Nations technicians and leadership.

Advancing water legislation without the voices of Treaty Peoples risks repeating past Government of Canada mistakes. As Chief Sheldon Sunshine of the Sturgeon Lake Cree Nation has stated repeatedly, I am concerned this bill will leave First Nations to shoulder the burden of broken financial promises. Furthermore, removing the explicit recognition of inherent Treaty rights to water is a significant step backward for reconciliation.

I urge you to pause progress and rethink what Canada is intending on Bill C-37, uphold the honour of the Crown, and immediately come back to the table in a good faith, transparent, nation-to-nation dialogue with the CSC and Treaty leadership to ensure this bill respects First Nations’ jurisdiction.
